Affiliate Policy

This Affiliate Policy governs participation in the SP Fabrication & Design Affiliate Partner Program ("Program"). By joining the Program, you ("Affiliate") agree to be bound by this policy in full. We reserve the right to modify this policy at any time — continued participation after changes constitutes acceptance.

1. Program Overview

The SP Fabrication & Design Affiliate Program allows approved partners to earn commissions by referring customers to our website. When a referred visitor completes a qualifying purchase using your unique affiliate link, you earn a commission on that sale.

To apply, visit our Affiliate Partner Program page. Applications are reviewed manually and we reserve the right to approve or decline any application at our discretion.

2. Commission Structure

Commissions are calculated as a percentage of the qualifying order subtotal (excluding taxes, shipping, and discounts). Your commission rate is displayed in your affiliate dashboard and may vary based on your agreement with us.

  • Commissions are only earned on completed, paid orders placed through your unique affiliate link.
  • Orders that are refunded, cancelled, or charged back are not eligible for commission. Any commission already paid on a subsequently refunded order may be deducted from future earnings.
  • Commission rates are subject to change with 30 days' notice.

3. Tracking & Attribution

Affiliate referrals are tracked via a unique link assigned to your account. Attribution is based on last-click, meaning the affiliate whose link was clicked most recently before a purchase receives credit.

  • Cookie duration: referrals are tracked for 30 days after the initial click.
  • Self-referrals (using your own affiliate link to make a purchase for yourself) are not eligible for commission and may result in account termination.
  • We cannot be responsible for lost referrals due to browser restrictions on cookies, ad blockers, or technical issues on the visitor's end.

4. Payment of Commissions

Commissions are reviewed and processed after a holding period to allow for potential returns or disputes. Approved commissions are paid via the method listed in your affiliate dashboard (e.g., bank transfer, PayPal) according to the following schedule:

  • A minimum payout threshold applies — earnings below this threshold roll over to the next payment cycle.
  • You are responsible for any taxes on commissions received. We will not withhold taxes on your behalf unless required by law.
  • Accurate payment details must be maintained in your affiliate account. We are not responsible for payments sent to incorrect information.

5. Promotional Guidelines

As an affiliate, you agree to promote SP Fabrication & Design honestly and in accordance with all applicable laws and regulations, including FTC disclosure requirements. You must:

  • Clearly disclose your affiliate relationship whenever promoting our products (e.g., "#ad", "#sponsored", or "I earn a commission on purchases made through this link").
  • Only use approved marketing materials, images, and brand assets provided by us.
  • Not make false, misleading, or exaggerated claims about our products or services.
  • Not use our brand name or trademarks in paid search ads (e.g., Google Ads, Bing Ads) without prior written approval.

6. Prohibited Activities

The following activities are strictly prohibited and may result in immediate termination and forfeiture of earned commissions:

  • Cookie stuffing, click fraud, or any artificial inflation of traffic or conversions.
  • Spam — sending unsolicited emails or messages promoting your affiliate link.
  • Self-referrals or referring immediate family members.
  • Using unauthorized discount codes or claiming promotional offers not part of our current program.
  • Operating websites or social media accounts that contain hate speech, illegal content, or content that could damage our brand reputation.
  • Misrepresenting your identity or relationship with SP Fabrication & Design.

7. Brand Use

We grant you a limited, non-exclusive, revocable license to use our approved brand assets (logos, product images, copy) solely for the purpose of promoting our products through the Program. You may not alter, modify, or create derivative works from our brand assets. All goodwill associated with use of our brand inures to our benefit.

8. Termination

Either party may terminate affiliate participation at any time, with or without cause, by providing written notice. We may terminate immediately and without notice for breach of this policy. Upon termination:

  • You must remove all affiliate links and brand assets from your platforms.
  • Commissions on orders placed before the termination date will be honored, subject to the standard holding period and return policy.
  • Commissions on orders placed after termination will not be paid.

9. Relationship of the Parties

You are an independent contractor, not an employee, agent, or partner of SP Fabrication & Design. You have no authority to enter into contracts or make representations on our behalf.

10. Limitation of Liability

SP Fabrication & Design's total liability to any affiliate under this program shall not exceed the total commissions paid to that affiliate in the 3 months preceding the claim. We are not liable for indirect, consequential, or punitive damages of any kind.

11. Governing Law

This Affiliate Policy is governed by the laws of the State of New Jersey, USA. Disputes shall be resolved in the courts of New Jersey.
